On 16.12.2019, the National Supervisory Authority [of Romania] completed an investigation at the SC Enel Energie S.A. operator, finding the following:
- violation of the provisions of art. 5 paragraph (1) d) and (2) of the General Regulation on Data Protection;
- violation of the provisions of art. 6 and art. 7 of the General Regulation on Data Protection;
- violation of the provisions of art. 21 paragraph (1) of the General Regulation on Data Protection.
The operator of S.C. Enel Energie S.R.L. it was sanctioned contravening with two fines, each amounting to 14,334.30 lei, the equivalent of 3000 EURO (therefore EUR 6,000) for the violation of art. 5 paragraph (1) lit. d), art. 6 paragraph (1) lit. a) and art. 7 paragraph (1) of the General Regulation on Data Protection, respectively for the violation of the provisions of art. 21 paragraph (1) of the General Regulation on Data Protection.
The sanctions were applied as a result of a complaint asserting that S.C Enel Energie S.A. illegally processed the data of the petitioner, was unable to prove his consent for sending notifications to his e-mail address and failed to respect the principle of accuracy. In addition, the operator did not take the necessary measures to disable the transmission of notifications, although the petitioner exercised his right of opposition (right to object, under Article 21 of the GDPR) on several occasions.
The fine was paid by the operator.
